NIH March-In request, now more than year old

The October 25, 2012 NIH March-In Request for ritonavir is now more than one year old, and the NIH has not decided to grant a hearing or reject the petition.

In a nutshell, the two substantive issues in the NIH petition are (1) the price of NIH funded inventions to Americans, and (2) the refusal to license an NIH funded invention. Right now the NIH poiicy is that (1) US citizens can pay more for NIH funded inventions, and (2) a patent holder can refuse to license an NIH funded invention, even when the invention is necessary “to effect significant health benefits from the second product.”
