WIPO Standing Committee on the Law of Patents (SCP 21): Intervention of Pakistan on Opposition Systems

On Tuesday, 5 November 2014, Pakistan delivered the following intervention on opposition systems.

Mr. Chairman,

The agenda item on quality of patents also include another item on “opposition systems” which was not discussed by the Committee. I want to make a small statement on opposition systems.

My delegation believes that the opposition systems both pre-grant and post-grant are imperative safeguard which ensure quality of patent. It is a check on the examination system of the patent offices that they have thoroughly examined all the information provided in the application. The opposition systems also ensure that patents are granted only on inventions that meet the patentability requirements as observed in document SCP/18/4.

We request the Secretariat to study procedures and modalities of the use of different opposition systems prevailing in various jurisdictions, constraints in using these systems effectively and how such constraints could be removed.

We are looking forward to have fruitful discussion on this topic.
