SCCR 29 KEI Statement on Limitations and Exceptions regarding Education

The Chair asked for specific and brief NGOs comments on limitations and exceptions regarding education. KEI focused on the US example (110 and fair use) and the language proposed in the African group document regarding classroom use:

>> KEI: Thank you, Mr. Chair. KEI would like to reiterate its support of the Committee’s continued work on this subject and in particular in relation to document SCCR/26/4 we’d like to reiterate our support for paragraph 22, submitted by the African Group. It is a text proposal for in classroom use and I just like to read out part of the text where it says access to educational materials limitation on remedies for infringement in which it said in addition to other copyright limitations and exceptions such as those included in Article 10 BIS the appendix in other Articles in the Berne Convention and consistent with Article 44.2 of the TRIPS Agreement members agree to establish appropriate limitations and exceptions on the remedies for infringement of works in the following circumstances. And then it goes on to enumerate these circumstances and we’d also like to reiterate our support for paragraph 21 which is a proposal from the United States of America where it describes section 110 of the
U.S. copyright Act. Thank you.
