Will WIPO convene a Diplomatic Conference on a Broadcasting Treaty in 2017?

The World Intellectual Property Organization’s (WIPO) General Assembly is currently engaged five separate informal consultations on the following topics: 1) Lisbon Union, 2) the future of the Intergovernmental Committee on Genetic Resources, Traditional Knowledge and Folklore, 3) the work program of the Standing Committee on Copyright and Related Rights (SCCR), 4) the Design Law Treaty and 5) WIPO External Offices.

Martin Moscoso, the chair of the SCCR, has been facilitating informal consultations WIPO’s work on the protection of broadcasting organizations and copyright limitations and exceptions. According the the revised tentative program distributed by the WIPO Secretariat, informal negotiations on the SCCR will take place today from 4:00 PM to 4:30 PM Geneva time in the Uchtenhagen room.

Sources close to the negotiation have provided KEI with the following text, prepared by Moscoso; it is understand that a new version could emerge after the informal discussions.

Currently, the language anticipates the possibility of convening a Diplomatic Conference for a Treaty for the Protection of Broadcasting Organizations in 2017; in contrast, language on copyright limitations and exceptions is less ambitious with the call to “continue and expedite” the work of the Committee on copyright limitations and exceptions.

Protection of Broadcasting Organizations

The Committee recommends that the 2015 General Assembly direct the Committee to expedite its work towards preparing a basic proposal for a treaty on the protection of broadcasting organizations. The 2016 General Assembly will take stock of progress made and decide on the convening of the Diplomatic Conference to be held in 2017, based on sufficient maturity of the text.

The Committee recommends that the 2015 WIPO General Assembly direct the Committee to continue and expedite its work on the topic of limitations and exceptions for libraries and archives.
