RE: Chair Proposal on Next Steps for Agenda Items 5 and 6
Dear Delegates at WIPO SCCR 39:
We are shocked by the attached proposal of the Chair to change the title of the agenda items on limitations and exceptions and prioritize discussions of the “role of licensing, contractual-based solutions, etc.”
We are also troubled by the measures that will have the effect of reducing action on limitations and exceptions to “capacity building” and “tool kits.”
This Committee has been focusing its work toward priority areas and has been advancing toward achievable international outcomes. The Chair’s proposal undermines this work.
The limitations and exceptions agenda has been mandated by the General Assembly. The promotion of licensing is not part of this agenda item.
If the Committee chooses to address “the role of licensing” it should be in a separate agenda item. Subject to agreement, such an agenda item should include discussion of unfair practices, transparency, and pricing.
We call for the rejection of this retrograde proposal which undermines more than a decade of work on this Committee.

RE: Propuesta del Presidente sobre los posibles próximos pasos para los temas 5 y 6 del programa
Estimados Delegados en el SCCR39 de la OMPI:
Nos impacta la propuesta adjunta del Presidente de cambiar el título de los puntos del orden del día sobre limitaciones y excepciones y priorizar los debates sobre el “papel de las licencias, soluciones basadas en contratos, etc.”.
También nos preocupa cómo las medidas tendrán el efecto de reducir la acción sobre las limitaciones y excepciones al “desarrollo de capacidades” y a los “toolkits”.
Este Comité ha estado enfocando su trabajo hacia áreas prioritarias y ha estado avanzando hacia resultados internacionales alcanzables. La propuesta del Presidente socava este trabajo.
El programa sobre limitaciones y excepciones ha sido establecido por la Asamblea General. La promoción de las licencias no forma parte de este punto del orden del día.
Si el Comité opta por abordar “el papel de las licencias”, debería incluirse en un punto separado del orden del día. Sujeto a que haya acuerdo, dicho punto del orden del día debe incluir la discusión de las prácticas desleales, transparencia y fijación de precios.
Pedimos que se rechace esta retrógrada propuesta que socava más de una década de trabajo en esta Comisión.

Objet: Proposition du président sur les prochaines étapes concernant les points 5 et 6.
Cher.s délégué.e.s de l’OMPI (SCCR),
Nous sommes choqués par la proposition du Président de modifier le titre des points de l’ordre du jour sur les limitations et exceptions, et de donner la priorité aux discussions sur le “rôle des licences, des solutions contractuelles, etc”.
Nous nous préoccupons également par les mesures qui auront pour effet de réduire l’action sur les limitations et exceptions au profit du “renforcement des capacités” et des “boîtes à outils”.
Le Comité a axé ses travaux sur les secteurs prioritaires et a progressé vers des résultats réalisables à l’échelle internationale. La proposition du Président compromet ce travail.
L’ordre du jour concernant les limitations et les exceptions a été mandaté par l’Assemblée générale. La promotion de l’octroi de licences ne fait pas partie de ce point de l’ordre du jour.
Si le Comité décide d’aborder la question de “l’octroi de licences”, celle-ci devrait être inscrite dans un point distinct de l’ordre du jour. Sous réserve d’un accord, ce point de l’ordre du jour devrait comprendre une discussion sur les pratiques déloyales, la transparence et la tarification.
Nous appelons au rejet de cette proposition rétrograde qui affaiblit plus d’une décennie de travail au sein de ce Comité.
